What Does California's Mask Order Mean for YOU?

Now that the threat of the Covid 19 pandemic is behind us, many Californian's do not feel it is necessary to wear a personal protective mask ("PPE"). Strangely, just as the pandemic scare was winding down in California, on June 18, 2020, Governor Gavin Newsome issued a state executive order dictating that Californians should wear PPE's in public. There has been a good deal of research on PPE's that demonstrate that PPE's are not protective of your person, their use is to protect others, and that PPE's do very little to protect others. Most alarmingly, much of the research has demonstrated the dangers of wearing a PPE on a regular basis, especially for certain groups of people or when they are used during any type of aerobic activity. PPE's are dangerous for children, the elderly, the disabled, and those with previous respiratory conditions (like asthma) when worn on a regular basis. Thankfully, the law leaves loopholes even for a destructive politician's executive orders. Here is a breakdown on the order.

In California, you must wear a PPE in:

Any indoor public space, including hallways, stairways, elevators, and parking facilities, when maintaining a physical distance of 6 feet from persons who are not members of the same household or residence is not feasible.

Obtaining services from the healthcare sector in settings including, but not limited to, a hospital, pharmacy, medical clinic, laboratory, physician or dental office, veterinary clinic, or blood bank.

Waiting for or riding on public transportation or paratransit or while in a taxi, private car service, or ride-sharing vehicle.

Engaged in work, whether at the workplace or performing work off-site, when: Interacting in-person with any member of the public; Working in any space visited by members of the public, regardless of whether anyone from the public is present at the time, Working in any space where food is prepared or packaged for sale or distribution to others.

Driving or operating any public transportation or paratransit vehicle, taxi, or private car service or ride-sharing vehicle when passengers are present.

The above are not as restrictive as the public seems to think. You do not have to wear a mask at work when you do not deal with members of the public. (someone you do not know). You do not have to wear PPE when exercising, even it is walking from your car to a shop, unless you come within 6 feet of the public. You do not need to wear a mask at home or in your car, unless you are an Uber or Lyft driver, with a member of the public in your car. You do have to wear one to receive medical treatment and inside shops and businesses, unless the business exempts you, some businesses are aware of their rights and yours and do not require PPE's.

Now for the exemptions.

Children under two are always exempt.

Persons with a medical condition, mental health condition, or disability that prevents wearing a face covering.

Persons who are hearing impaired or communicating with a person who is hearing impaired.

Persons for whom wearing a face covering would create a risk to the person related to their work.

Persons who are obtaining a service involving the nose or face for which temporary removal of the face covering is necessary to perform the service.

Persons who are seated at a restaurant or other establishment that offers food or beverage service, if your party is social distancing (6 feet apart) from another party.

Persons who are engaged in outdoor work or recreation such as swimming, walking, hiking, bicycling, or running.

Persons who are incarcerated.

It is important that you do not wear a PPE if you have a condition that would make wearing a PPE dangerous. This means that if you any type of breathing disorder, a cold, asthma, allergies, or any other condition of the head and face, you do not have to wear a mask, ANYWHERE! That's right. If you do have a disability or a breathing condition, it is important that you protect your right to breathe from overreaching communist businesses. If you are stopped by an employee of a business, and told to put on a PPE, calmly explain that you are exempt from the order. You are not required to prove a medical condition or disability to be allowed to exercise your exemption rights. If the business insists, tell them that you are requesting a reasonable accommodation to their policy. Take note of the employee's name and the date of the incident and ask for a business card from the store manager. California Law says that they must accommodate, you, and if they do not, they can be sued or discrimination, among other things.
